General Terms and Conditions of Lens24

1. Validity of the General Terms and Conditions and conclusion of contract

1.1 The following General Terms and Conditions apply to all deliveries between us and you as a customer in the version valid at the time of the order.

The following provisions on the conclusion of the contract apply to orders via the webshop of www.lens24.ch (hereinafter “Webshop”) as well as to all other ordering options made available by us currently or in the future (namely orders via e-mail or messenger services such as WhatsApp). hereinafter referred to as “LENS24”.

1.2 The presentation of the goods in our webshop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to you as a customer to order goods and represents a non-binding online catalog. The offer to conclude a purchase contract is made by you as the customer by clicking on the “Place order” button (order) after completing the order page. You remain bound to your order for seven (7) days. After you have placed your order, you will receive an automated confirmation email (order confirmation) regarding receipt of your order, which does not, however, constitute acceptance of the contract. The purchase contract is deemed to have been concluded when you receive an order confirmation from us by email or, at the latest, when the goods are delivered. If, by way of exception, the order is not executed until after the aforementioned seven-day period has expired, the delivery of the goods shall constitute a new offer to conclude a purchase contract. You can accept this offer tacitly by accepting the goods and putting them to use or expressly. In this respect, we waive receipt of the declaration of acceptance.

1.3 If it becomes known after conclusion of the contract that the goods will not be available from the supplier in the foreseeable future, we reserve the right to withdraw from the contract. In this case, we will inform you immediately after becoming aware of the unavailability of the goods and refund any consideration already received without delay.

1.4 If a purchase contract is concluded, we at LENS24 do not save the text of the contract. However, we will send you your order data by email and save it in our customer area. You can view past orders there after logging in under “My account -> Order history”.

2. Description of the offer and prescription/eye correction

2.1 LENS24 endeavors to name product descriptions as accurately as possible. To this end, original information from the manufacturer and supplier is used, but without guarantee of accuracy. Changes on the part of the manufacturer may occur without prior notice.

2.2 Deviations from images of individual products cannot be excluded, especially in the case of images of colored contact lenses, as these depend on your own eye color. LENS24 endeavors to keep the images up to date.

2.3 Colors and patterns of the frames supplied may differ from the images on the Internet. Tint colors of lenses may also differ from the images on the Internet.

2.4 LENS24 does not determine or check the individual refractive error of the customer. In order to order contact lenses or corrective spectacles, it is necessary to specify the defective vision (correction values, prescription data or spectacle pass details). The customer is responsible for providing the correct information. LENS24 recommends regular consultation with an ophthalmologist to check the correction values, update the prescription and undergo a medical examination. LENS24 accepts no liability for incorrect information.

3. Prices and payment

3.1 Prices are quoted in Swiss francs (CHF) and include VAT.

3.2 The customer has the option of paying by credit card (Visa, Mastercard, Maestro), PayPal or Twint.

3.3 LENS24 reserves the right to change prices at any time. The prices published in the webshop on the order date shall apply to customers. If the prices in the webshop are increased or reduced before delivery of the goods, the price at the time of the order shall apply, even if the contract has not yet been confirmed.

3.4 Vouchers and special discounts are not cumulative and can only be redeemed once per household.

3.5 Your personal data will be transmitted to Intrum AG for the purpose of credit checks. Detailed information about Intrum's data processing can be found under the following link.

If the amount to be paid by the customer cannot be definitively credited due to insufficient credit card or account funds or is charged back for other reasons, LENS24 shall be entitled to charge the customer a flat-rate compensation fee of CHF 80 for chargeback costs. This lump sum for damages may be increased if higher damages have been incurred in individual cases.

3.6 Until full payment of the respective invoice amount of a delivery (final and unconditional crediting of the total purchase price including any ancillary costs), LENS24 shall in any case retain title to the delivered goods. LENS24 shall not be obliged to deliver until payment has been made in full. If full payment is not made within a maximum of 30 days after order confirmation, LENS24 reserves the right to withdraw from the contract.

3.7 Costs in the event of late payment: processing fee (at the earliest after two reminders after the invoice date, if handed over to a debt collection service provider) in accordance with www.fairpay.ch.

4. Delivery

4.1 LENS24 makes every effort to keep delivery times as short as possible. However, delivery times stated in the order confirmation are non-binding.

4.2 LENS24 is entitled to make partial deliveries. In this case, the customer shall only be charged the shipping costs once.

4.3 If the customer's address changes, the customer shall be obliged to notify LENS24 immediately. If the customer fails to notify LENS24, the last known address shall be the delivery address. The customer shall bear the costs of determining the address and any additional delivery costs.

4.4 The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the customer until the goods have been handed over to the customer.

4.5 Transport damage caused by delivery shall be insured by LENS24. The insurance claim can only be asserted if the customer has the damage confirmed by the supplier upon delivery of the product.

5. Right of return

5.1 We grant you a 30-day right of return on products purchased from us (subject to exceptions) under the following conditions and will refund the purchase price (subject to deductions for certain products).

5.2 To be able to make use of this right for contact lenses and contact lens care products, the packaging must be undamaged and in unopened condition. Annual lenses and toric contact lenses are excluded from this right of return.

5.3 We also grant you a 30-day right of return for prescription spectacles, even though these have been manufactured to your individual requirements. As part of this money-back guarantee, we will refund the purchase price. For prescription glasses, we deduct a service fee from the purchase price to be refunded: CHF 50.00 for single vision glasses and CHF 150.00 for varifocal glasses.

5.4 To make use of the right of return, please return the goods to us in as-new condition within 30 days of the date of dispatch with the original packaging. Please use the enclosed invoice/delivery bill as a return slip. The 30-day right of return begins with the dispatch of the goods and the return ends with the timely dispatch. The time of dispatch of the goods shall be decisive for compliance with the return period. The costs for the return shipment are to be borne by you. The return is to be sent to:

5.5 We will accept the return if the goods are in their original condition and the original invoice is enclosed. We reserve the right to deduct the corresponding costs from the purchase price to be refunded as compensation for possible damage or excessive wear and tear.

5.6 If the return has been accepted by LENS24, payments already made will be refunded free of charge within 30 days of receipt of the goods, less the service fee for prescription glasses mentioned in section 5.3 and deductions for possible damage or excessive wear and tear mentioned in section 5.5. Discount vouchers will not be refunded under this right of return. The purchase price will be refunded using the payment method you selected when placing the order.

6. No warranty

Any warranty obligation of LENS24 is hereby excluded and the assertion of warranty rights by the customer is thus excluded.

7. Liability

7.1 Subject to mandatory statutory provisions to the contrary, LENS24 shall only be liable in cases of intent and gross negligence. If LENS24 is liable by law for slight negligence, it shall only be liable to the extent that the damage was reasonably foreseeable at the time the contract was concluded.

7.2 Clause 6 (1) shall also apply to vicarious agents, representatives or executives of LENS24.

7.3 LENS24 shall not be liable for damage caused by improper use. Contact lens wearers should have their contact lenses checked regularly by an ophthalmologist or optician (see Section 11). LENS24 recommends that customers have their eyes checked at least every 6 months. To avoid impairment of vision, the specified wearing times (according to the packaging insert) must not be exceeded. Clean and care for your contact lenses according to the instructions of your ophthalmologist or optician. Please only order contact lenses that have been fitted to you and for which you know the correct parameters. Never use damaged contact lenses. If you experience eye irritation, remove your contact lenses immediately and contact your ophthalmologist or optician.

7.4 LENS24 is not liable for the content of external links. The content and updating of linked websites and/or websites of affiliate partners are the sole responsibility of their operators.

7.5 All cases of breach of contract and their legal consequences as well as all claims of the customer, irrespective of the legal grounds on which they are based, are conclusively regulated in these GTC. Under no circumstances shall the customer be entitled to claim compensation for damage that has not occurred to the goods themselves. Liability claims exceeding the value of the order are excluded. This exclusion of liability does not apply to unlawful intent (willful misconduct) or gross negligence.

8. Security and privacy

8.1 Data protection is a central concern of LENS24 and we comply with the applicable legal requirements when processing personal data. We store our customers' data and pass it on to partners (e.g. opticians) or other parties where this is necessary prior to the conclusion of a contract or for the execution of a contract. Furthermore, we assure you that we will not pass on your address data to other third parties.

8.2 Registered users: If you register as a user, LENS24 reserves the right to provide you with a LENS24 newsletter. You can unsubscribe from this newsletter service at any time.

8.3 Backup of customer information: When you place an order with us and thus make your account information accessible, we use a security certificate (data encryption) for your protection. The security certificate (SSL) encrypts all information that you enter before it is sent to us. In addition, all customer data is protected against unauthorized access using state-of-the-art measures. However, we would like to point out that one hundred percent data security cannot be guaranteed for transmissions over the Internet.

10. Confirmation

By placing your order, you confirm the following points:

You have been wearing the same contact lenses as the contact lenses ordered from LENS24 for at least 6 months without any complaints

The contact lens values provided with your order correspond to the information provided by an ophthalmologist or optician who has fitted you with contact lenses.

You have been examined by an ophthalmologist or optician within the last 12 months and no complications related to contact lens wear have been identified

If you experience any complications or discomfort from wearing contact lenses, please stop wearing them immediately and consult an ophthalmologist or optician without delay

LENS24 accepts no liability for complications, compatibility, discomfort, incorrect use and handling or any other problems that may arise

You confirm that you already wear contact lenses and know how to handle and care for them

To avoid eye damage, you have regular check-ups by an ophthalmologist or optician

You confirm that you have reached the age of 18

11. Severability clause

Should individual provisions of these GTC be unenforceable or invalid, they shall only be invalid to the extent that they are unenforceable or invalid and must be replaced by a valid and enforceable provision which the parties assume in good faith comes closest to the invalid or unenforceable provision in economic terms. The remaining contractual provisions shall remain in full force and effect in any case.

12. Reservation of right of amendment

12.1 LENS24 may amend these GTC at any time. The changes shall be notified to the Customer by e-mail or in another suitable manner online. As soon as the Customer makes use of the services of LENS24 after the amendment, he implicitly accepts the new GTC. 12.2 Any other contractual terms and conditions of the Customer, in particular those which the Customer declares to be applicable together with the acceptance of the contract, shall not become part of the contract. They shall only be valid if and insofar as they have been expressly accepted by LENS24 in writing.

13. Application of law and place of jurisdiction

13.1 These GTC shall be governed by substantive Swiss law to the exclusion of the conflict of laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

13.2 The exclusive place of jurisdiction shall be Zurich. Alternatively, LENS24 shall also be entitled to sue customers at their domicile //.
